1. Nature of Services

Arcan LLC provides informational and inquiry-routing services only.

Arcan LLC:

• Is not a lender

• Does not provide funding directly

• Does not approve or deny funding

• Does not set funding terms

The Services are intended solely to connect users with independent third-party providers.

2. No Guarantees

Submission of information through the Services does not guarantee:

• Approval

• Funding

• Specific terms or rates

• Timing or availability of funding

All eligibility determinations, decisions, and offers are made solely by third-party providers.

3. Fees

Arcan LLC does not charge users:

• Upfront fees

• Application fees

• Advisory fees

Third-party providers may charge fees or costs under their own agreements.

4. Third-Party Relationships

Any interactions, agreements, communications, or transactions with third-party providers, affiliates, or service partners are solely between you and that provider. Arcan LLC is not responsible for third-party actions, offers, decisions, or outcomes.

5. Acceptable Use

You agree not to:

• Submit false, misleading, or incomplete information

• Use the Services for unlawful purposes

• Interfere with or disrupt system security or operation

Submission of inaccurate or incomplete information may result in inability to connect with funding providers.

6. Intellectual Property

All content, trademarks, and materials associated with the Services are owned by or licensed to Arcan LLC. Unauthorized use is prohibited.

7. Licensed Brands

Arcan LLC may operate under licensed brand names. Use of any brand does not create a separate legal entity or modify these Terms.

8. Communications Authorization

By submitting information through the Services, you expressly authorize Arcan LLC and any of its operated or licensed brands, including but not limited to Prosirvity®, MaxFunding.io, and any other current or future licensed brand names, its affiliates, as well as third-party funding providers, affiliates, and service partners, to contact you using the contact information you provide.

Such contact may include, but is not limited to, communications initiated by human representatives or AI-assisted or automated systems, and may be delivered via email, telephone calls, text messages, or other communication methods, for purposes related to your inquiry, potential funding options, follow-up questions, or related business services.

You understand that such communications are connected to services you have requested or expressed interest in by submitting your information through the Services. You may opt out of non-essential communications at any time by following the instructions provided in such communications or by contacting us directly.

9. Limitation of Liability

To the fullest extent permitted by law, Arcan LLC shall not be liable for:

• Funding outcomes or decisions

• Third-party actions or representations

• Indirect, incidental, or consequential damages
  

10. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.

11. Modifications

Arcan LLC may modify these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms.
